(THE BHARATIYA NAGARIK SURAKSHA SANHITA 2023 | பாரதிய நியாயக் சுரக்ஷா சன்ஹிதா 2023) BNSS 2023/85 Chapter-VI Attachment of property of person absconding | தலைமறைவான நபரின் சொத்தை இணைத்தல்

BNSS 2023/85/1 The Court issuing a proclamation under section 84 may, for reasons to be recorded in writing, at any time after the issue of the proclamation, order the attachment of any property, movable or immovable, or both, belonging to the proclaimed person:

Provided that where at the time of the issue of the proclamation the Court is satisfied, by affidavit or otherwise, that the person in relation to whom the proclamation is to be issued,—

BNSS 2023/85/1 பிரிவு 84ன் கீழ் ஒரு பிரகடனத்தை வெளியிடும் நீதிமன்றம், எழுத்துப்பூர்வமாக பதிவு செய்யப்பட வேண்டிய காரணங்களுக்காக, அறிவிப்பு வெளியான பிறகு, எந்த நேரத்திலும், அறிவிக்கப்பட்ட நபருக்குச் சொந்தமான அசையும், அல்லது அசையாச் சொத்தை, அல்லது இரண்டையும் இணைக்க உத்தரவிடலாம்:

பிரகடனத்தை வெளியிடும் நேரத்தில் நீதிமன்றம் திருப்தி அடைந்த இடத்தில், உறுதிமொழி மூலம் அல்லது அவ்வாறு இல்லையெனில், பிரகடனம் வெளியிடப்பட வேண்டிய நபர் தொடர்பாக,-

  • BNSS 2023/85/1/(a) is about to dispose of the whole or any part of his property; or
  • BNSS 2023/85/1/(a) அவரது சொத்தின் முழுமையும் அல்லது எந்த பகுதியையும் அப்புறப்படுத்த; அல்லது
  • BNSS 2023/85/1/(b) is about to remove the whole or any part of his property from the local jurisdiction of the Court
  • BNSS 2023/85/2 (b) நீதிமன்றத்தின் உள்ளூர் அதிகார வரம்பிலிருந்து அவரது சொத்தின் முழு அல்லது எந்தப் பகுதியையும் அகற்ற
  • it may order the attachment of property simultaneously with the issue of the proclamation.
  • பிரகடனத்துடன் ஒரே நேரத்தில் சொத்தை இணைக்கவும் உத்தரவிடலாம்.
