BNSS 2023/103 CHAPTER VII Disposal of things found in search beyond jurisdiction.

When, in the execution of a search-warrant at any place beyond the local jurisdiction of the Court which issued the same, any of the things for which search is made, are found, such things, together with the list of the same prepared under the provisions hereinafter contained, shall be immediately taken before the Court issuing the warrant, unless such place is nearer to the Magistrate having jurisdiction therein than to such Court, in which case the list and things shall be immediately taken before such Magistrate; and, unless there be good cause to the contrary, such Magistrate shall make an order authorising them to be taken to such Court.

If a search warrant is carried out outside the local area of the Court that issued it, and some items are found:

  • Those items, along with a list of them, must be taken immediately to the Court that issued the warrant.
  • But, if the search place is closer to another Magistrate who has authority there, then the items and the list can be taken to that Magistrate instead.
  • That Magistrate will normally order that the items be sent to the original Court which issued the warrant (unless there is a good reason not to).

👉 In short: Items seized in a search outside the issuing Court’s area must go to the nearest Magistrate or back to the issuing Court, to keep things proper and legal.
