BNSS 2023/84/1 If any Court has reason to believe (whether after taking evidence or not) that any person against whom a warrant has been issued by it has absconded or is concealing himself so that such warrant cannot be executed, such Court may publish a written proclamation requiring him to appear at a specified place and at a specified time not less than thirty days from the date of publishing such proclamation

எந்தவொரு நீதிமன்றமும் தனக்கு எதிராக வாரண்ட் பிறப்பிக்கப்பட்ட எந்த நபரும் தலைமறைவாகிவிட்டார் அல்லது ஒழிந்துக் கொண்டிருக்கிறார் என்று நம்புவதற்கு (ஆதாரம் எடுத்த பின்னரோ இல்லையோ) காரணம் இருந்தால்,
அத்தகைய உத்தரவு நிறைவேற்றப்பட முடியாத நிலையில், அத்தகைய நீதிமன்றம் அவர் ஒரு குறிப்பிட்ட இடத்தில், குறிப்பிட்ட நேரத்தில், 30 நாட்களுக்கு குறைவில்லாமல் ஆஜராக வேண்டும் என்று எழுத்துப்பூர்வ அறிவிப்பை வெளியிடலாம்.

BNSS 2023/84/2 The proclamation shall be published as follows | பிரகடனம் பின்வருமாறு வெளியிடப்படும்

• BNSS 2023/84/2 (i) (a) it shall be publicly read in some conspicuous place of the town or village in which such person ordinarily resides
• அத்தகைய நபர் சாதாரணமாக வசிக்கும் நகரம் அல்லது கிராமத்தின் சில வெளிப்படையான இடத்தில் இது பகிரங்கமாக அறிவிக்கப்படும்.
• BNSS 2023/84/2 (i) (b) it shall be affixed to some conspicuous part of the house or homestead in which such person ordinarily resides or to some conspicuous place of such town or village;
• BNSS 2023/84/2 (i) (b) அத்தகைய நபர் சாதாரணமாக வசிக்கும் வீடு அல்லது வீட்டுத் தோட்டத்தின் சில வெளிப்படையான பகுதியிலோ அல்லது அத்தகைய நகரம் அல்லது கிராமத்தின் சில குறிப்பிடத்தக்க இடத்திலோ ஒட்டப்பட வேண்டும்;
• BNSS 2023/84/2 (i) (c) a copy thereof shall be affixed to some conspicuous part of the Court-house;
• BNSS 2023/84/2 (i) (c) நீதிமன்றத்தின் சில குறிப்பிடத்தக்க பகுதியில் அதன் நகல் ஒட்டப்படும்;
• BNSS 2023/84/2 (ii) the Court may also, if it thinks fit, direct a copy of the proclamation to be published in a daily newspaper circulating in the place in which such person ordinarily resides
• BNSS 2023/84/2 (ii) நீதிமன்றம் பொருத்தமானதாக நினைத்தால், அத்தகைய நபர் சாதாரணமாக வசிக்கும் இடத்தில் விநியோகிக்கப்படும் தினசரி செய்தித்தாளில் பிரகடனத்தின் நகலை வெளியிடுமாறு அறிவுறுத்தலாம்.

BNSS 2023/84/3 A statement in writing by the Court issuing the proclamation to the effect that the proclamation was duly published on a specified day, in the manner specified in clause (i) of sub-section (2), shall be conclusive evidence that the requirements of this section have been complied with, and that the proclamation was published on such day

BNSS 2023/84/3 துணைப்பிரிவு (2) இன் ஷரத்து (i) இல் குறிப்பிடப்பட்டுள்ள விதத்தில், ஒரு குறிப்பிட்ட நாளில் பிரகடனம் முறையாக எழுத்துப்பூர்வமாக நீதிமன்றத்தால் பிரகடனத்தை வெளியிடுவது, மேற்படி பிரிவுகளுக்கு இணங்க, குறிப்பிட்ட நாளில் அறிவிப்பு செய்துவிட்டதாகும்.

BNSS 2023/84/4 Where a proclamation published under sub-section (1) is in respect of a person accused of an offence which is made punishable with imprisonment of ten years or more, or imprisonment for life or with death under the Bharatiya Nyaya Sanhita, 2023 or under any other law for the time being in force, and such person fails to appear at the specified place and time required by the proclamation, the Court may, after making such inquiry as it thinks fit, pronounce him a proclaimed offender and make a declaration to that effect.

BNSS 2023/84/4 துணைப்பிரிவு (1) இந்த கீழ், வெளியிடப்பட்ட ஒரு பிரகடனம், பத்து ஆண்டுகள் அல்லது அதற்கு மேற்பட்ட சிறைத்தண்டனை, அல்லது பாரதிய நியாய சன்ஹிதா, 2023 இன் படியும், அல்லது ஏதேனும் நடைமுறையில் உள்ள சட்டத்தின் கீழ், ஆயுள் அல்லது மரண தண்டனை விதிக்கப்படும் குற்றத்தரிக்காக, குற்றம் சாட்டப்பட்ட நபர், பிரகடத்தில் கண்டவாறு ஒரு குறிப்பிட்ட நேரத்தில், ஆஜராகாத நபரை, நீதிமன்றம் கருதியவாறு விசாரணை தொடங்கும்.

BNSS 2023/84/5 The provisions of sub-sections (2) and (3) shall apply to a declaration made by the Court under sub-section (4) as they apply to the proclamation published under sub-section (1).

BNSS 2023/84/5 துணைப் பிரிவுகள் (2) மற்றும் (3) இன் விதிகள், துணைப் பிரிவு (1) இன் கீழ் வெளியிடப்பட்ட பிரகடனத்திற்குப் பொருந்துவதால், துணைப் பிரிவு (4) இன் கீழ் நீதிமன்றத்தால் செய்யப்பட்ட அறிவிப்புக்கு பொருந்தும்.
