THE BHARATIYA NAGARIK SURAKSHA SANHITA, BNSS 2023 / Section 50

(2)(i) a person is arrested by a police officer under a warrant which does not provide for the taking of bail, or under a warrant which provides for the taking of bail but the person arrested cannot furnish bail, and

(1)(I) ஜாமீன் எடுப்பதற்கு வழங்காத பிடியாணையின் கீழ், அல்லது ஜாமீன் எடுப்பதற்கு வகை செய்யும் பிடியாணையின் கீழ் ஒருவர் காவல்துறை அதிகாரியால் கைது செய்யப்படுகிறார், ஆனால் கைது செய்யப்பட்ட நபர் ஜாமீன் வழங்க முடியாது, மற்றும்

(ii) a person is arrested without warrant, or by a private person under a warrant, and cannot legally be admitted to bail, or is unable to furnish bail, the officer making the arrest or, when the arrest is made by a private person, the police officer to whom he makes over the person arrested, may search such person, and place in safe custody all articles, other than necessary wearing-apparel, found upon him and where any article is seized from the arrested person, a receipt showing the articles taken in possession by the police officer shall be given to such person.

(ii) ஒரு நபர், பிடி வாரண்ட் இல்லாமல் கைது செய்யப்படும்போதும்,, அல்லது ஒரு தனி நபரால் கைது செய்யப்படும்போதும், மேலும் சட்டப்படி ஜாமீன் வழங்க முடியாத போதும், அந்த நபர் உடுத்தி இருக்கும் உடைகளை தவிர, மற்ற அனைத்து பொருட்களையும், பாதுகாப்பாக காவலில் வைக்கலாம். அப்படி கைப்பற்றப்படும் பொருட்களை குறிப்பு எடுத்து, அந்த குறிப்பு விபரத்தை கைது செய்யப்பட்ட நபரிடம் கட்ட வேண்டும்.

(2) Whenever it is necessary to cause a female to be searched, the search shall be made by another female with strict regard to decency.

ஒரு பெண்ணைத் சோதிக்க வேண்டிய அவசியம் ஏற்படும் போதெல்லாம், கண்ணியத்துடன் கண்டிப்பான மற்றொரு பெண்ணால் சோதனை மேற்கொள்ளப்படும்.
