Original Title : Protection of children from sexual offence act | Part – 1 | Aspirant to Judicial Exam

பகுதி 1 — தொடக்க அறிமுகம்

• பேசுபவர் தன் அனுபவத்தைப் பகிர்ந்து, சில குற்றவியல் (Criminal) சட்ட விசயங்களை விளக்கப் போகிறார்.
• இதில் POCSO Act என்பது முக்கியமானது என கூறுகிறார்.
• மாவட்ட நீதிபதி (District Judge) தேர்விற்கும் இது மிகவும் முக்கியமான தலைப்பு.

பகுதி 2 — POCSO ஆக்ட் பற்றிய அடிப்படை தகவல்

• POCSO Act = Protection of Children from Sexual Offences Act
• எந்த வருடத்தில் நிறைவேற்றப்பட்டது? → 2012
• இதில் 9 chapters, 46 sections உள்ளன.
• இது sexual assault, sexual harassment, child pornography போன்றவற்றிலிருந்து குழந்தைகளை பாதுகாக்க உருவாக்கப்பட்டது.
• ஆக்ட்–இன் பிரதான நோக்கம்:
  “குழந்தைகளை பாலியல் துன்புறுத்தலிலிருந்து பாதுகாக்குதல்.”

பகுதி 3 — POCSO Act Gender-Neutral ஆக்டா?

• POCSO சட்டம் Gender Neutral (ஆண்–பெண் இருவருக்கும் சமமாகப் பொருந்தும்) என்று உருவாக்கப்பட்டது.
• ஆனால் Karnataka High Court–ல் நடந்த ஒரு வழக்கு இந்த விவகாரத்தை கேள்விக்குள்ளாக்கியது:
  • 52 வயது பெண் ஒருவர் 7-ம் வகுப்பு படிக்கும் சிறுவனைத் துன்புறுத்தியதாக குற்றம்.
  • High Court சில provisions ஜெண்டர் ஸ்பெசிபிக் (only male offender) என்று கூறியது.
  • இதை Supreme Court–ல் appeal செய்தனர்.

பகுதி 4 — Supreme Court இல் நடந்தது

• Supreme Court இந்த விவகாரத்தில் notice அனுப்பியது.
• “POCSO Act gender neutral தானா அல்லது சில பகுதிகள் male-only provisions ஆ?” என்ற கேள்வி பரிசீலனையில் உள்ளது.
• இந்த விவகாரம் Archana Battile vs State of Karnataka என்ற வழக்கில் வந்தது.

பகுதி 5 — POCSO Court, Sessions Court, Anticipatory Bail

• POCSO Act ஒரு self-contained code.
• ஆனாலும் அதன் many procedural parts = CrPC follow செய்யும்.
• POCSO Court = Sessions Court “designated as Special Court”.

Anticipatory Bail:

• CrPC Section 438 → anticipatory bail provision.
• POCSO Act–ல் தனியே anticipatory bail section இல்லை.
• சில நீதிபதிகள்: “POCSO Court anticipatory bail entertain செய்யக்கூடாது” என்று கூறினர்.
• சிலர்: “Sessions Court தான் entertain செய்யலாம்” என்றனர்.

இதனால் ஒரு பெரிய குழப்பம் உருவானது.

பகுதி 6 — கரூர், மதுரை சம்பவம் & High Court Clarification

• கரூரில் ஒரு POCSO judge anticipatory bail entertain செய்ய மறுத்தார்.
• பின்னர் Sessions Court–ல் பைல் செய்யப்பட்டது.
• இது High Court attentionக்கு போய் Reference u/s 395 CrPC கேட்டனர்.

High Court Division Bench தீர்ப்பு:

• Anticipatory bail application → Special POCSO Courtல் maintainable.
• காரணம்:
  • POCSO Court = Sessions Judge (Sec 28)
  • Sec 31 → CrPC provisions including bail apply unless contrary.
  • ஆகவே anticipatory bail POCSO Court-இல் maintainable.

பகுதி 7 — Criminal Courts–க்கு Review Power இல்லாது

• CrPC Section 362:
  • Criminal Court once judgement passed → review / alter செய்ய முடியாது.
  • Only clerical mistakes correct செய்யலாம்.
• Civil Court மட்டும் review செய்யும் power உண்டு.

பகுதி 8 — POCSO Act Definitions (மிகவும் முக்கியம்)

Child = Section 2(d)

• “Below 18 years”.

Definitions not available in POCSO → Section 2(2)

• POCSOல் வராத வார்த்தைகளின் meaning பெற:
  • IPC
  • CrPC
  • Juvenile Justice Act
  • Information Technology Act
    இவற்றைக் காணலாம்.

பகுதி 9 — ஒரு செயல் பல சட்டங்களிலும் offence ஆனால் என்ன செய்ய வேண்டும்?

உதாரணம்:

• ஒரு சம்பவம் IPC 376A, 376B க்கு உட்பட்டது.
• அதே நேரம் POCSO Act Section 4 அல்லது 6 கும் உட்பட்டது.

எந்த சட்டத்தின் தண்டனை பயன்படுத்த வேண்டும்?

Section 42 & 42A POCSO:

• இரண்டு சட்டங்களிலும் punishment வந்தால்
  👉 Greater punishment prescribed in any law → அதைத்தான் பயன்படுத்த வேண்டும்.

உதா:

• POCSO punishment life imprisonment (simple)
• IPC punishment → remainder of natural life
• IPC punishment greater → IPC apply.

பகுதி 10 — Section 6, 4 punishments & Amendment

• 2016க்கு பிறகு “life imprisonment meaning remainder of life” என்ற கருத்து கொண்டுவரப்பட்டது.
• அதற்கு முன்பு life imprisonment என்பது general life term.
